Welcome to StarRuby.in! The terms “we,” “us,” and “our” refer to Star Ruby Gems DMCC, the author and operator of this website and store. StarRuby.in is powered by Shopify, which enables us to provide you (the “Customer”) with a curated shopping experience (the “Services”).

These Terms of Service (“Terms”), together with any policies referenced herein (including our Privacy Policy), govern your access to and use of the Services, including your purchase of loose gemstones and related products (“Products”). By visiting, interacting with, or ordering from our Site, you agree to be bound by these Terms.

1. Access & Account

  • 1.1 Age & Capacity. You represent that you are at least 18 years old and capable of forming a binding contract under UAE law.
  • 1.2 Account Information. To browse or purchase, you may need to provide your name, email, billing, payment, and shipping information. You warrant that all information is accurate, current, and complete, and that you have the right to use any payment method you supply.
  • 1.3 Security. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not share or transfer your account without our prior written consent.

2. Our Products, Guarantees & Warranties

  • 2.1 Unique Nature. Each gemstone is a unique natural product. While we strive for accuracy in listings and images, minor variations may occur due to screen settings or photography.
  • 2.2 Certification & Authenticity. Where applicable, we provide independent gemological reports from internationally recognized laboratories (e.g., GIA, GRS, IGI) to verify authenticity. These may be included with the product or made available upon request.
  • 2.3 Listing Variations. We make every effort to ensure that all product listings are accurate and thoroughly detailed. However, variations may arise—particularly in the determination of geographic origin and treatments—due to differences in testing methods and standards among gemological laboratories.
  • 2.4 Guarantees.

    If the gemstone was certified at the time of sale, the item is sold strictly "as-is" based on the certification provided. If you intend to submit the stone to a different laboratory (especially a local one), we advise contacting us first. Some laboratories may not possess the advanced tools or expertise required for accurate origin determination or treatment analysis, which can lead to discrepancies in the findings.

    If the gemstone was not certified at the time of sale, and a reputable international laboratory (e.g., GIA, GRS, IGI) later issues a report that contradicts our listing description specifically regarding treatment or geographic origin, we will accept the return of the stone.

  • 2.5 Warranties. We are not liable for damage resulting from improper handling, third-party setting/mounting, or alterations post-purchase.
  • 2.6 Limitation of Liability. Our liability in all cases is limited to the purchase price paid by you.

3. Orders & Acceptance

  • 3.1 Offer & Acceptance. Placing an order is your offer to purchase. We reserve the right to accept or decline any order for reasons including stock availability, pricing errors, anti–money‑laundering–related red flags or suspected fraudulent activity. An order is only binding once we send you a confirmation email.

4. Prices & Billing

  • 4.1 Currency. All product prices are denominated in USD and will be used as the base currency during checkout.
  • 4.2 Exchange Rates. Exchange rates displayed on our website are based on live market data and are provided for reference only. Please note that there may be slight differences between the displayed rate and the actual conversion rate applied by your card issuer or payment provider at the time of transaction.
  • 4.3 Payment Methods. Payments are accepted via credit/debit cards, PayPal, or bank transfer. Please refer to the Payment page for more details.
  • 4.4 Advance Payment. Full payment must be made before the order is dispatched.

5. Customer Responsibilities

  • 5.1 Accuracy of Information. Ensure all information provided during ordering is accurate and complete.
  • 5.2 Due Diligence. Review each product’s specifications, photos, and certificates before purchase.
  • 5.3 Handling. Follow proper handling and care instructions provided with gemstones.
  • 5.4 Invoice. Retain your invoice and any third‑party certification for your records.
  • 5.5 AML Policies and KYC Forms. Where applicable, submit copies of valid identification documents and complete all KYC documentation in compliance with UAE GoAML regulations.

6. Cancellation

  • 6.1 Right to Cancellation. We reserve the right to cancel orders at our discretion and issue a full refund.
  • 6.2 Cancellation Timeline. Orders may be canceled prior to shipment. Once shipped, the order cannot be canceled and is subject to the return policy above.

7. Shipping, Insurance & Delivery

  • 7.1 Global Shipping. We ship globally. Shipping charges, timelines, and applicable customs duties will be shown at checkout. Please refer to the Shipping & Insurance page for more details. However, we do not ship to countries or regions subject to international sanctions under US, EU, or UN regulations. This includes, but is not limited to: North Korea, Iran, Iraq, Syria, Cuba, and Sudan.
  • 7.2 Estimates Only. Delivery timelines are estimates and not guarantees. Delays caused by customs or logistics partners are outside our control.
  • 7.3 Title & Risk of Loss. The title and risk of loss pass to you when the carrier delivers the package to your specified address.
  • 7.4 Unboxing Video. Due to the high value of our products, please record an uninterrupted video when opening your shipment; this serves as proof for any claim of loss, damage, or tampering.

8. Returns & Refunds

  • 8.1 Return Policy. We want you to shop with complete confidence. That’s why we offer a 30-day, no-questions-asked return policy on all purchases. Please refer to the Returns page for more details.
  • 8.2 Refund Processing Time. Refunds are processed within 1–3 business days after we receive the returned item in its original condition, along with any accompanying gemological reports (if applicable). The refund will be issued to your original method of payment.

9. Intellectual Property

  • 9.1 Right to Use. All content, imagery, trademarks, and product data on StarRuby.in are the intellectual property of Star Ruby Gems DMCC, Dubai and are used with appropriate rights.
  • 9.2 Unauthorized Use. Reproduction or unauthorized use of our images, videos and product data is prohibited.

10. Optional Tools

We may offer third‑party tools (e.g., calculators, filters). These are provided “as‑is,” with no warranties, and your use of them is at your own risk.

11. Third Party Links

Our Site may link to external websites. We do not control or endorse their content, and we are not liable for any interaction or transaction you have with them.

12. Relationship with Shopify

StarRuby.in runs on Shopify’s platform, but all sales are made directly between you and Star Ruby Gems DMCC. Shopify is not responsible for any aspect of your purchase or any disputes arising from it.

13. Privacy Policy

Your personal data is handled in accordance with our Privacy Policy and Shopify’s Privacy Policy. By using our Services, you consent to those terms.

14. Feedback

If you submit ideas or feedback (“Feedback”), you grant us a perpetual, worldwide, royalty-free license to use and modify it for any purpose, including commercial use.

15. Prohibited Use

You agree not to use the Services to violate any laws, infringe IP rights, distribute malware, spam, or engage in harassment or other objectionable conduct. We may suspend or terminate access for violations.

16. Termination

We may terminate or suspend your access at any time for any reason, without notice. Sections that by their nature survive termination (e.g., IP, disclaimers, indemnification) will continue in effect.

17. Indemnification

You agree to indemnify and hold harmless Star Ruby Gems DMCC, Shopify, and their affiliates from any claims, losses, or expenses arising from your breach of these Terms or your use of the Services.

18. Severability

If any provision is found invalid, that provision will be enforced to the maximum extent possible, and the remaining Terms will remain in full force.

19. Waiver and Entire Agreement

Failure to enforce any right is not a waiver. These Terms (and policies they reference) constitute the entire agreement between you and us regarding the Services.

20. Assignment

You may not assign these Terms without our consent. We may freely assign or delegate our rights and obligations.

21. Dispute Resolution & Governing Law

Any disputes shall be governed by the laws of the United Arab Emirates. Jurisdiction is limited to the courts of Dubai. We aim to resolve customer disputes amicably and encourage you to contact our support team first.

Headings are for convenience only and do not affect interpretation.

23. Updates to Terms

  • 23.1 Changes. We reserve the right, at our sole discretion, to change or modify portions of these Terms at any time without further notice. You should periodically visit this page to review the current Terms so you are aware of any revision to which you are bound.
  • 23.2 Use of Service. Your continued use of the service after any such changes constitutes your acceptance of the new Terms. If you do not agree to abide by these or any future Terms, do not use or access (or continue to use or access) the service.
